Uno de los principales debates en torno a la Alcestis de Eurípides es su clasificación dramática, pues a pesar de ser representada en el lugar que habría ocupado un drama satírico, no tiene elementos característicos de dicho género, como el coro compuesto de sátiros, pero sí posee características propias de la tragedia (estructura, temáticas), a la vez que tiene un final feliz al modo de la comedia. Como lo apunta Voelke (2015), la esencia del encuentro entre tragedia y drama satírico (...) en Alcestis yace en la confrontación de la vida y la muerte a partir de la cual se estructura la obra. Uno de los elementos en los que se condensa dicha confrontación es el discurso de Heracles sobre la muerte (773-802), el cual parece estar atravesado por una visión filosófica sobre la muerte. Sin embargo, es pronunciado en medio de la ebriedad. Heracles mismo es un personaje ambiguo que se desenvuelve en la tragedia como en la comedia, tanto así que puede ser considerado como un equivalente de Dionisio. Por tanto, aquí quisiéramos explorar en qué medida, a partir de esa confluencia de elementos satíricos y trágicos, es posible encontrar una concepción de la muerte en el discurso de Heracles. Esta investigación fue apoyada por los entes nacionales COLCIENCIAS y COLDEPORTES y permitió (...) visualizar cómo los seres humanos han encontrado en sus “gadgets” una nueva forma de estar, sentir la ciudadanía y ser en la ciudad. La era de la información y la cultura de la conectividad, ha catalizado notablemente nuevas posibilidades para la comprensión del espacio público, la aprehensión y comprensión de la ciudad, la conformación de grupos y asociaciones en relación con gustos, actividades y luchas conjuntas, es decir, los dispositivos móviles se están consolidando como la ventana contemporánea, que permite ver, encontrarse y conocer la ciudad o cualquiera de sus actores, con la ventaja de estar siempre al alcance de la mano. INTRODUCTION BY NANCY FUMERO What is a translation that stalls comprehension? That, when read, parsed, obfuscates comprehension through any language – English, Portuguese. It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. There is the expectation that translations enable mobility. That what was (...) written in one language be accessible in another. And that a translator is to serve as a mediator, acting ultimately in service to ideas within the source text. To disperse them. However, this notion of translation is partly antithetical to the ideas in Rosa’s work. Or, alternately, to convey the despair of terrain slipping beneath one’s feet, and to encounter the heightened suspense of magic, the translation, as part of its strategy, cannot devotedly rely on its original language, not as its source text. The work undertaken by Felipe W.Martinez is a new form of translation that risks everything in order to encounter the same treacherous knowing Rosa had traversed. And it takes its risks by not taking risks: by being, almost word for word, a literal translation. This is an approach that reductively converts, as opposed to translates. The idiomatic differences between English and Portuguese are not accented. The syntax is not finessed. Liberties are not assumed on account of improving readability. What stands, resoundingly amid such absences, is the awakened challenge of reading. The genuine peril of not knowing. That is, this translation, one that purports to know nothing, creates access into the guileful world Rosa had created in Portuguese. But not by translating. If anything, GRANDE SERTÃO: VEREDAS is speaking a cosmic language through a linguistic one. And W.Martinez does us the service of recognizing this, as what configures the shapes of words and sentences is not as simple as neologisms, portmanteaus, and digressions, but as terrifying as the path the fool traverses: all paths. As such, this translation doesn’t speak English, just as the original does not speak Portuguese. It is the assemblage of paradox as a new logic that can be navigated, if only one could suspend the comfort of readability, of expectation. If one could descend a mountain in the pitch dark of night, each step shocking the body, unable to acclimate to the unleveled heights. Without a doubt, the translation is incongruous to the Portuguese. Taking a small excerpt to compare: Eh, well, thereafter, the rest the Sir provide: comes the bread, comes the hand, comes the god, comes the dog. What is striking is the interplay between “god” and “dog”. To most English speakers, this anagram is a familiar one. But in Portuguese the words god (“deus”) and dog (“cão”) are not so closely linked. In fact, there is no direct mention of “deus” in Rosa’s text: Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Both are fascinating. In Rosa’s excerpt, the rhythm is unmistakable and precise, despite, of course, the indices of hesitation: the commas, the Eh, the uncomfortable way of searching through prolongation and wait. This is the sort of paradox Rosa can engage within a sentence. W.Martinez’s does this as well, at a scale that reverberates beyond the sentence, and with one noticeable addition: deus. What may appear to be an overstep, to add such a weighted word that draws out wordplay but is, nevertheless, not in the source text, is exemplary of risk. The translation buzzes because of it. This is because throughout the text we encounter dogs frequently, as some primal beast on par with humans. The dog is one that masters and can be mastered. A creature that is at times its face, and at others a mask. It is a powerful presence. For the translator to be attuned to the reverent undercurrent attributed to this animal, and create within the translation such charged play in English from what was only an implication in Portuguese, is in tribute to the grand beauty within dissonance. What aberrant modes of writing and translation can teach us most assuredly, is that things, words, are not in states of rightness or wrongness, but of oscillation. This isn’t so different from what Rosa says himself: The Sir look…see: the most important and beautiful, of the world, is this: that the people are not always same, still were not completed — but that they go always shifting. O Aleixo não perdeu o juizo; mas mudou: ah, demudou completo – agora vive da banda de Deus, suando para ser bom e caridoso em todas suas horas da noite e do dia. Parece até que ficou o feliz, que antes não era. Ele mesmo diz que foi um homem de sorte, porque Deus quis ter pena dele, transformar para lá o rumo de sua alma. Isso eu ouvi, e me deu raiva. Razão das crianças. Se sendo castigo, que culpa das hajas do Aleixo aqueles meninozinhos tinham?! Compadre meu Quelemém reprovou minhas incertezas. Que, por certo, noutra vida revirada, os meninos também tinham sido os mais malvados, da massa e peça do pai, demônios do mesmo caldeirão de lugar. Senhor o que acha? E o velhinho assassinado? – eu sei que o senhor vai discutir. Pois, também. Em ordem que ele tinha um pecado de crime, no corpo, por pagar. Se a gente – conforme compadre meu Quelemém é quem diz – se a gente torna a encarnar renovado, eu cismo até que inimigo de morte pode vir como filho do inimigo. Mire veja: se me digo, tem um sujeito Pedro Pindó, vizinho daqui mais seis léguas, homem de bem por tudo em tudo, ele e a mulher dele, sempre sidos bons, de bem. Eles têm um filho duns dez anos, chamado Valtei – nome moderno, é o que o povo daqui agora apreceia, o senhor sabe. Pois essezinho, essezim, desde que algum entendimento alumiou nele, feito mostrou o que é: pedido madrasto, azedo queimador, gostoso de ruim de dentro do fundo das espécies de sua natureza. Em qual que judia, ao devagar, de todo bicho ou criaçãozinha pequena que pega; uma vez, encontrou uma crioula bentabêbada dormindo, arranjou um caco de garrafa, lanhou em três pontos a popa da perna dela. A gente sabe, espia, fica gasturado. O menino já rebaixou de magreza, os olhos entrando, carinha de ossos, encaveirada, e entisicou, o tempo todo tosse, tossura da que puxa secos peitos. Na fazenda O Limãozinho, de um meu amigo Vito Soziano, se assina desse almanaque grosso, de logogrifos e charadas e outras divididas matérias, todo ano vem. Em tanto, ponho primazia é na leitura proveitosa, vida de santo, virtudes e exemplos – missionário esperto engambelando os índios, ou São Francisco de Assis, Santo Antônio, São Geraldo... Eu gosto muito de moral. Raciocinar, exortar os outros para o bom caminho, aconselhar a justo. Minha mulher, que o senhor sabe, zela por mim: muito reza. Ela é uma abençoável. Compadre meu Quelemém sempre diz que eu posso aquietar meu temer de consciência, que sendo bem-assistido, terríveis bons-espíritos me protegem. Ipe! Com gosto... Como é de são efeito, ajudo com meu querer acreditar. Mas nem sempre posso. O senhor saiba: eu toda a minha vida pensei por mim, forro, sou nascido diferente. Eu sou é eu mesmo. Diverjo de todo o mundo... Eu quase que nada não sei. Mas desconfio de muita coisa. This collection highlights the new trend away from rationalism and toward empiricism in the epistemology of modality. Accordingly, the book represents a wide range of positions on the empirical sources of modal knowledge. Readers will find an introduction that surveys the field and provides a brief overview of the work, which progresses from empirically-sensitive rationalist accounts to fully empiricist accounts of modal knowledge. Early chapters focus on challenges to rationalist theories, essence-based approaches to modal knowledge, and the prospects for naturalizing (...) modal epistemology. The middle chapters present positive accounts that reject rationalism, but which stop short of advocating exclusive appeal to empirical sources of modal knowledge. The final chapters mark a transition toward exclusive reliance on empirical sources of modal knowledge. They explore ways of making similarity-based, analogical, inductive, and abductive arguments for modal claims based on empirical information. In the sacrificial moral dilemma task, participants have to morally judge an action that saves several lives at the cost of killing one person. According to the dual process corrective model of moral judgment suggested by Greene and collaborators (2001; 2004; 2008), cognitive control is necessary to override the intuitive, deontological force of the norm against killing and endorse the utilitarian perspective. However, a conflict model has been proposed more recently to account for part of the evidence in favor of (...) dual process models in moral and social decision making. In this model, conflict, moral responses and reaction times arise from the interplay between individually variable motivational factors and objective parameters intrinsic to the choices offered. To further explore this model in the moral dilemma task, we confronted three different samples with a set of dilemmas representing an objective gradient of utilitarian pull, and collected data on moral judgment and on conflict in a 4-point scale. Collapsing all cases along the gradient, participants in each sample felt less conflicted on average when they gave extreme responses (1 or 4 in the UR scale). They felt less conflicted on average when responding to either the low- or the high-pull cases. The correlation between utilitarian responses and conflict was positive in the low-pull and negative in the high-pull cases. This pattern of data suggests that moral responses to sacrificial dilemmas are driven by decision conflict, which in turn depends on the interplay between an objective gradient of utilitarian pull and the moral motivations which regulate individual responsiveness to this gradient. Analisamos a crítica de Georges Politzer (1998) à hipótese freudiana do inconsciente (Freud, 1996, 2018), com base na abordagem que adotamos, a Perspectiva de Segunda Pessoa, desenvolvida mais recentemente por Diana Pérez e Antoni Gomila (2018, 2021). Em específico, buscamos entender melhor o reconhecimento de estados psicológicos através do relato pessoal, buscando superar a dicotomia epistemológica entre primeira e terceira pessoa, na qual se concentra Politzer. Nossa contribuição para os estudos em Filosofia da Psicologia consiste em delimitar e extrair consequências (...) específicas do âmbito próprio de casos de segunda pessoa, como na prática clínica aqui focalizada, a fim de robustecer abordagens cuja tentativa de compreensão dos fenômenos psicológicos parecia até então limitada. In this paper, I argue that, despite the progress made in recent years, virtue argumentation theory still lacks a more systematic acknowledgment of other-regarding virtues. A fuller recognition of such virtues not only enriches the field of research of virtue argumentation theory in significant ways, but also allows for a richer and more intuitive view of the virtuous arguer. A fully virtuous arguer, it is argued, should care to develop both self-regarding and other-regarding virtues. Hospitals are paying increasing attention to the delivery of humanized care. The purpose of this study was to explore from the nursing perspective what hospital managers might do to facilitate this. A secondary analysis from a primary ethnographic study regarding dignity in nursing practice was conducted. Twenty interviews of internal medicine nurses from four hospitals were analyzed, and three main themes were identified: Management of nursing teams, Management of ethical values, and Management of the context. It is important for institutional (...) values to be closely aligned with those of the nursing profession, and nurse managers play a key role in ensuring that the latter are applied in practice. Neste artigo analisamos o conceito de eu quantificado a partir na Perspectiva de Segunda Pessoa, segundo a qual a eu-dade, ou pessoalidade, é atualizada em relações contexto-dependentes de total ou parcial transparência cognitiva não redutíveis aos aspectos considerados nas perspectivas de primeira ou de terceira pessoa. O eu quantificado designa o indivíduo que realiza medições sobre si mesmo por meio de tecnologias ubíquas em rede para obter um suposto maior autoconhecimento, instanciando, segundo alguns autores, um ponto de vista de Quarta (...) Pessoa constituído por relações de alteridade (pessoa-máquina-pessoa) emergentes, em especial, em um cenário sociocultural permeado por tecnologias ubíquas e análises de big data. Procuraremos problematizar a tese de que o automonitoramento digital promoveria um aprofundamento do autoconhecimento, defendida pelos postuladores da quantificação do eu. Procuraremos mostrar que a coleta de dados sobre si mesmo por meio de tecnologias ubíquas não favorece necessariamente a constituição/atualização da pessoalidade porque o automonitoramento digital mediado pode interferir significativamente nos modos de interação social da Segunda Pessoa e no autoconhecimento que tal interação pode promover. Resumen Nicolás Gómez Dávila caracteriza la Modernidad democrática como una época gnóstica. En este artículo pretendo reconstruir esta caracterización a partir de una lectura intertextual de Textos. Desde una filosofía de la historia y desde una antropología filosófica Gómez Dávila interpreta fenómenos históricos como la Modernidad y la democracia con una perspectiva que privilegia lo religioso. Su conclusión es que en la Modernidad democrática el ser humano se ha arrogado atributos divinos, es decir, se ha divinizando. Así, intentaré mostrar cómo (...) funciona la intertextualidad de Textos en la crítica a la Modernidad democrática y ofreceré además algunas consideraciones críticas.Nicolás Gómez Dávila characterizes democratic Modernity as a gnostic age. This article pretends to reconstruct his characterization by way of an intertextual reading of Textos. Gómez Dávila’s thesis is derived from a philosophy of history and a philosophical anthropology; both allow him to interpret Modernity from a religious perspective. His conclusion is that democratic Modernity bestows human beings unlimited sovereignty, which for him means gnostic divinization. Morality and Legal Law are obligatory markers, which although considered in their own field, are not excluded, but different as to object and method. Predominantly, Justice is exposed as one of the great values of the Law, and main theories in order to offer future lawyers the basis regarding the current Science of Law and its significance. Resumen Valparaíso es un ejemplo paradigmático de las crisis e inestabilidades del capitalismo y de la modernización latinoamericana durante los siglos XIX y XX. Su historia de riqueza, segregación, cosmopolitismo y decadencia, se proyecta en la escritura respecto de la ciudad, que problematizamos a partir de los conceptos de desterritorialización y extrañamiento, ya que percibimos una presencia importante de autores extranjeros y afuerinos en la producción literaria porteña. Para analizar la elaboración textual de unas subjetividades cuyos referentes y marcos culturales (...) se tensionan en Valparaíso, proponemos siete períodos: 1) de los viajeros ilustrados; 2) de los debates fundacionales; 3) del modernismo y la poesía social; 4) de las vanguardias expresionista e imaginista; 5) de la novela social; 6) de la novela del aprovinciamiento; 7) y de la poesía del exilio, en que el proceso se invierte y algunos poetas porteños escriben acerca de Valparaíso en el extranjero.Valparaíso is a paradigmatic example of Capitalism's crisis and instabilities and of Latin American modernization during the XIX and XX centuries. Its history of wealth, segregation, cosmopolitism, and decadence is projected in the writings about the city, which we problematize based on the concepts of deterritorialization and alienation, since we perceive a significant presence of foreign and outsider authors in the literary production of Valparaíso. To analyze the textual elaboration of some subjectivities whose points of reference and cultural frameworks are tensioned in Valparaíso, we propose seven periods: 1) the enlightenment travellers; 2) the foundational debates; 3) modernism and social poetry; 4) the expressionist and imaginist vanguards; 5) the social novel; 6) the provincial novel; 7) and the poetry of exile, where the process reverses and some local poets write about Valparaíso while overseas. The practice of physical activity (PA) contributes to the prevention of chronic diseases such as obesity, metabolic syndrome or cardiovascular diseases, being also directly related to the individual’s physical fitness. Therefore, it is necessary to measure and monitoring the levels of PA in childhood and adolescence, since it may be useful to describe their current health status and the association with physical fitness, as well as to reveal putative consequences in the future. Within the educational field, it has been shown (...) that physical education (PE) classes are a favorable context for the creation of healthy physical-sports habits and self-determined motivation could be a key for explaining the level of PA practice. For this reason, the purpose of this research was to study the mediating role of integrated regulation (IR) on the relationship between PA and physical fitness in children and adolescents. A total of 325 students between 11 and 14 years old participated in the study. The level of PA was estimated through the specific Physical Activity Questionnaire for Children (PAQ-C), while motivation and IR were measured by using the Perceived Locus of Causality scale (PLOC-2). In addition, physical fitness was measured through the Eurofit fitness battery of tests, composed of three body composition measures and seven tests of different physical capacities. Este artículo tiene el objetivo de delimitar el componente epistemológico en la indagación reflexiva de las teorías procedimentales de la justicia, específicamente, describiendo el modo en el que se exacerban en un modus operandi que se denomina como cartesianismo político, es decir, como la búsqueda cognitiva de ideas claras y distintas que normativizan la administración de la vida; posteriormente, se propondrá, en antagonismo al cartesianismo político, la posibilidad de regular la indagación en torno a los procedimientos para lograr una estructura (...) básica de justicia social a partir del principio de interlocución lógica, como garantía del primer principio de una teoría procedimental de la justicia: la imparcialidad. En esta dirección, se expondrá el carácter cultural y epistémico de la imparcialidad, tratando de relaborar un marco de comprensión que, en vez de prescindir de las mentalidades culturales, las incluya como elemento dinamizador de la interacción en los procedimientos de elección de estructuras básicas de justicia. El presente trabajo se propone esclarecer en qué medida el principio establecido por Kant en la Fundamentación de la metafísica de las costumbres constituye un conocimiento. Se mostrará que, al reconstruir la caracterización kantiana de conocimiento práctico, podemos luego examinar de qué manera aquella obra se trata justamente de alcanzar ese tipo de conocimiento. Tal investigación se ve justificada, por un lado, porque ayudaría a comprender el lugar sistemático de la obra en cuanto en ella hay un conocimiento necesario para (...) la ciencia ética y, por otro lado, iluminaría cierto aspecto del debate contemporáneo respecto de si acaso la filosofía moral de Kant es realista o antirrealista en alguna de sus variantes. Para aquello es necesario comenzar por aclarar qué entiende Kant por conocimiento práctico, y luego ver cómo esto se realiza o no en dicha obra, finalmente bosquejaremos los posibles rendimientos filosóficos que esto logra en relación con otras aproximaciones contemporáneas a la filosofía moral de Kant. Se describen varios elementos que le permiten a la fenomenología elaborar una descripción del ser humano sin renunciar a lo que tiene de ontología universal o antropologización, lo que implica que en todo análisis de la conciencia general deben caer la razón humana, la paradoja de la subjetividad o, lo que es lo mismo, la paradoja de la conciencia en su estado humano. De aquí se desprende que ella pueda ser observada en un sujeto que posee un cuerpo con el (...) cual y desde el cual la experiencia y la percepción pueden tener lugar. Esto valida el ejercicio de interrogar a la razón por su genética antropológica en un proceso de filogenias. This article describes the various elements which allow phenomenology to develop a description of the human being without giving up its status of universal ontology or anthropologization, which implies that any analysis of general awareness refers to human reason, the paradox of subjectivity, or, in other words, the paradox of con-sciousness in its human state. From this it follows that it can be observed in a subject that has a body with which and from which experience and perception can take place. This validates the action of interrogating reason for its anthropological genetics in a process of phylogenies. (shrink)

In this paper, I sketch a new model for the format of the content of understanding states, Compressible Graph Maximalism (CGM). In this model, the format of the content of understanding is graphical, and compressible. It thus combines ideas from approaches that stress the link between understanding and holistic structure (like as reported by Grimm (in: Ammon SGCBS (ed) Explaining Understanding: New Essays in Epistemollogy and the Philosophy of Science, Routledge, New York, 2016)), and approaches that emphasize the connection between (...) understanding and compression (like Wilkenfeld (Synthese 190(6):997–1016, 2018)). I argue that the combination of these ideas has several attractive features, and I defend the idea against some challenges. (shrink)

El monstruo es, más que una entidad, un operador conceptual que pone en evidencia las categorías, los cánones y formas habituales de la vida que una sociedad exige, forma, interioriza y difunde entre sus individuos a través de (...) sus visiones del mundo. A partir del siglo XVIII estos hechos dieron paso a una gran preocupación por lo anormal expresada en diversos estudios de la biología, la psiquiatría, la medicina y la política. Este artículo sugiere cómo las concepciones desarrolladas por Michel Foucault acerca del poder, la dominación y la criminalidad explican cómo se construyeron nuestras concepciones de la monstruosidad y la anormalidad. En un desarrollo futuro la presente investigación se pondrá en relación con algunas de las principales novelas góticas. (shrink)

Airway mucin secretion is important pathophysiologically and as a model of polarized epithelial regulated exocytosis. We find the trafficking protein, SNAP23, selectively expressed in secretory cells compared with ciliated and basal cells of airway epithelium by immunohistochemistry and FACS, suggesting that SNAP23 functions in regulated but not constitutive epithelial secretion. Heterozygous SNAP23 deletant mutant mice show spontaneous accumulation of intracellular mucin, indicating a defect in baseline secretion. However mucins are released from perfused tracheas of mutant and wild-type mice at the (...) same rate, suggesting that increased intracellular stores balance reduced release efficiency to yield a fully compensated baseline steady state. In contrast, acute stimulated release of intracellular mucin from mutant mice is impaired whether measured by a static imaging assay 5 min after exposure to the secretagogue ATP or by kinetic analysis of mucins released from perfused tracheas during the first 10 min of ATP exposure. Together, these data indicate that increased intracellular stores cannot fully compensate for the defect in release efficiency during intense stimulation. The lungs of mutant mice develop normally and clear bacteria and instilled polystyrene beads comparable to WT mice, consistent with these functions depending on baseline secretion that is fully compensated. This article explores the relationships between legal proof and fundamental epistemic concepts such as knowledge and justification. A survey of the legal literature reveals a confusing array of seemingly inconsistent proposals and presuppositions regarding these relationships. This article makes two contributions. First, it reconciles a number of apparent inconsistencies and tensions in accounts of the epistemology of legal proof. Second, it argues that there is a deeper connection between knowledge and legal proof than is typically argued for or presupposed in (...) the legal literature. This connection is illustrated through a discussion of the Gettier problem in epistemology. It is argued that the gap or disconnect between truth and justification that undermines knowledge in Gettier cases also potentially undermines the success of legal verdicts. (shrink)

La utilización de las nociones de “conservador” y “progresista” en las ciencias sociales (y en la opinión pública) ha llegado a configurar dos ideologías políticas. En este número se tratan, a partir de Kant, diversos sentidos de tales nociones en el contexto actual: la perspectiva de la Economía constitucional de Buchanan, la concepción de la sociedad abierta de Popper, la teoría de la justicia de Rawls y la concepción filosófica de la vida social y política de Ortega y Gasset.

En este artículo describiremos la vitalidad del sistema fonológico del mapudungun hablado por escolares pewenches de la Provincia del Biobío, VIII Región. Específicamente, nos hemos propuesto: a) Determinar los fonos/fonemas, y su fonotaxis, que se relevan como indicadores de vitalidad, b) Identificar las transferencias fonético-fonológicas presentes en la fonología del pewenche hablado por estos escolares y c) Interpretar las transferencias encontradas en términos del grado de vitalidad de la fonología de la lengua. La muestra está conformada por un grupo de (...) 20 escolares bilingües de entre 12 y 15 años de edad, que se encuentran cursando 7° y 8° año básico en escuelas rurales pertenecientes a dos comunidades pewenches del valle del Queuco, en la comuna de Alto Biobío. Para la recolección del material fonológico, se aplicó a los participantes una lista léxica de 65 ítems, material que se complementó con la narración oral en mapudungun de un cuento. Según nuestros datos, hemos podido constatar la existencia de una serie de rasgos fónicos en el mapudungun hablado por los escolares pewenches que obedece a la influencia de las estructuras fonológicas del castellano. Sin embargo, el grado y la difusión de los fenómenos de transferencia se desarrollan de manera heterogénea en ambas comunidades en estudio, debido, entre otros factores, a la intensidad del contacto. In this article we will describe the vitality of the phonological system Mapudungun spoken by Pewenche schoolchildren from the Biobío province, VIII Region. We intend: a) To determine the phones/phonemes, and their phonotactics, which are revealed as vitality markers. b) To identify the phonetic-phonological transferences which are present in the Pewenche spoken by these schoolchildren, and, c) To interpret the transferences found in terms of the degree of the language phonological vitality. The sample is composed of 20 bilingual schoolchildren from 12 to 15 years old, who are in 7th and 8th grade in rural primary schools belonging to two Pehuenche comunities from Valle del Queuco, in the city of Alto Biobío. To collect the phonological material, we applied a 64-item lexical list, which was complemented with the oral narration of a tale in Mapudungun. According to our data, we have been able to verify the existence of a series of phonic features in the Mapudungun spoken by Pewenche schoolchildren, which originate because of the influence of the Spanish phonological structure. However, the degree and spread of the transference phenomena develop in a heterogeneous way in both of the studied communities. due to the contact intensity, among other possible factors. (shrink)

Proposed lie-detection technology based on neuroscience poses significant challenges for the law. The law must respond to the science with an adequate understanding of such evidence, its significance, and its limitations. This paper makes three contributions toward those ends. First, it provides an account of the preliminary neuroscience research underlying this proposed evidence. Second, it discusses the nature and significance of such evidence, how such evidence would fit with legal practices and concepts, and its potential admissibility. ABSTRACTThis article defends the importance of epistemic safety for legal evidence. Drawing on discussions of sensitivity and safety in epistemology, the article explores how similar considerations apply to legal proof. In the legal context, sensitivity concerns whether a factual finding would be made if it were false, and safety concerns how easily a factual finding could be false. The article critiques recent claims about the importance of sensitivity for the law of evidence. In particular, this critique argues that sensitivity does (...) not have much of an effect on the value of legal evidence and that it fails to explain legal doctrine. By contrast, safety affects the quality of legal evidence, and safety better explains central features of the law of evidence, including probative value, admissibility rules, and standards of proof.
